- While in Ch13 bankruptcy, can a borrower engage in negotiating the sale of his property, and then take the offer to the BK trustee, and lender, for their approval?

- The asset manager provided the chain of assignments and it showed it to be complete. When compared with that on the title report, the title report had not picked up one assignment because it was not recorded. Upon investigating closely, it was discovered that that missing assignment was in fact wrongly recorded in the adjacent county! Is this an issue? In spite of it, a sale date was able to be set! See attachment.A corrective assignment was ultimately recorded, but I fail to understand its order.Mahmood Motani
Hello all
We just got a call from a note seller on a MH&L deal in Prescott, AZ. It’s been a while since we had a call like this, but it reminded me of the days of all the direct mail.
The note seller was referred to me by their title company, who is servicing the loan for them.
Anyway, seller wants to of course sell the whole loan and wants to know what the discount is.
Had to brush off my seller financing sales script for this one!!!
It’s only been seasoning for six months with a good payment history and borrower put 20% down.
Supposedly the only reason they couldn’t get financing is because it’s a 1977 wobbly box on 6.1 acres of land. No value to the box, but land appraised at $45K a few years ago.
